Welcome to RackStar. These Terms of Service ("Terms") govern your use of the RackStar application and related services (collectively, the "Service") operated by NV-IT ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using RackStar in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
You must be at least 16 years of age to use RackStar. By using the Service, you represent and warrant that you meet this age requirement.
2. Account Creation and Responsibility
To use RackStar, you must create an account using a supported authentication provider (Google or Microsoft). When creating an account, you agree to:
- Provide accurate and complete information.
- Maintain the security of your account credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
You are solely responsible for maintaining the confidentiality of your authentication credentials. We are not liable for any loss or damage arising from your failure to protect your account.
3. Acceptable Use
You agree to use RackStar only for its intended purpose and in compliance with all applicable laws. You must not:
- Use the Service for any unlawful or fraudulent purpose.
- Attempt to gain unauthorized access to other users' accounts or data.
- Interfere with or disrupt the Service or its infrastructure.
- Upload or transmit malicious code, viruses, or harmful content.
- Use automated systems (bots, scrapers) to access the Service without permission.
- Harass, abuse, or threaten other users through the Service.
- Manipulate game scores, statistics, or leaderboard rankings dishonestly.
- Impersonate another person or entity.
- Use the Service to send spam or unsolicited messages.
4. Intellectual Property
The RackStar application, including its design, code, graphics, logos, trademarks, and all related content, is the exclusive property of NV-IT and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not:
- Copy, modify, or distribute any part of the Service.
- Reverse engineer, decompile, or disassemble the Service.
- Remove or alter any proprietary notices or labels.
- Use the RackStar name, logo, or branding without prior written consent.
5. User Content
You may submit content through the Service, such as comments during games, display names, and profile information ("User Content"). By submitting User Content, you:
- Retain ownership of your User Content.
- Grant us a non-exclusive, worldwide, royalty-free license to use, display, and store your User Content as necessary to operate the Service.
- Represent that you have the right to submit such content and that it does not violate any third-party rights.
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.
6. Game Data and Statistics
Game scores, statistics, and leaderboard data are generated through your use of the Service. While we strive for accuracy, we do not guarantee that game data will be error-free. We reserve the right to correct or adjust game data if errors are discovered.
7. Service Availability
We aim to keep RackStar available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance and updates.
- Unexpected technical issues or outages.
- Circumstances beyond our control (force majeure).
We are not liable for any loss or inconvenience caused by Service downtime.
8. Limitation of Liability
To the maximum extent permitted by applicable law, NV-IT and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:
- Loss of data, profits, or business opportunities.
- Service interruptions or errors.
- Unauthorized access to your account.
- Any conduct or content of third parties on the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Account Termination
We reserve the right to suspend or terminate your account at any time if:
- You violate these Terms of Service.
- Your account is used for fraudulent or illegal activity.
- We are required to do so by law.
- We discontinue the Service (with reasonable notice).
You may also request deletion of your account at any time by contacting us at support@rackstar.app. Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our Privacy Policy.
10. Indemnification
You agree to indemnify, defend, and hold harmless NV-IT and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service or violation of these Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Belgium.
12. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically to stay informed about the conditions governing your use of RackStar.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
